For Respondent : Mr.T.Senthil Kumar Additional Public Prosecutor PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C. PRAYER :- For Anticipatory Bail in Crime No.253 of 2022 on the file of the Respondent Police.

ORDER : The Court made the following order :- The petitioner, who is arrayed as A3, apprehending arrest at the hands of the respondent police for the offence punishable under Sections 8(c)20(b)(ii)(B) and 25 of Narcotic Drugs & Psychotropic Substances Act, 1985, on the file of the respondent Police, seeks anticipatory bail.

2.The case of the prosecution is that the petitioner and other accused were found in possession of 1.150 kgs of Ganja. Hence, the case has been registered.

CRL OP(MD).No.14014 of 2022 3.The learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution. He further submitted that based on the confession statement of A1 and A2, the petitioner has been implicated in this case. Hence, he prayed for grant of anticipatory bail to the petitioner.

4.The learned Additional Public Prosecutor, on instructions, submitted that this petitioner is arrayed as A3. This petitioner and other accused persons are in possession of 1.150 kgs of Ganja and he strongly opposed to grant anticipatory bail to the petitioner. 5.Considering the above facts and circumstances of the case and considering the fact that the petitioner and other accused persons are in possession of 1.150 kg of Ganja and bad antecedents of the petitioner, custodial interrogation of the petitioner is very much required in this case, hence this court is not inclined to grant anticipatory bail to the petitioner.
