ORDER

The petitioners with a grievance that their complaint dated 14.07.2023 was not registered by the respondent Police, have approached the learned Judicial Magistrate, Theni and filed a petition in Crl.M.P.No.11308 of 2023 under Section 156(3) Cr.P.C. seeking a direction to the respondents Police to register FIR based on their complaint dated 14.07.2023. The learned Judicial Magistrate, Theni, on 12.02.2024, passed an order directing the respondents Police to conduct a preliminary enquiry and register a case, if any cognizable offence is made out. Even thereafter, the respondents Police have not taken any steps to register a case. Therefore, the petitioners are before this Court. 2/5

2. Today, when the matter is taken up for hearing, the learned Additional Public Prosecutor appearing for the respondents Police submits that they have closed the complaint as it is purely civil in nature and they have also submitted a report before the learned Judicial Magistrate, Theni, on 24.04.2024.

3. Recording the said submission, this Criminal Original Petition is closed with a direction to the respondents Police to furnish a copy of the report to the petitioners enabling them to workout their remedy in the manner known to law.
