PRAYER: Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the 1st respondent herein to dispose of the petitioner's appeal on merits, which is pending with him vide proceedings made in Na.Ka.Aa1/873/2024, dated 09.01.2024, pertaining to the property situated in Karur District, Krishnarayapuram North, Ward-10, S.F.No.175/24 admeasuring hector 0.05.62 ares.

ORDER

The grievance of the petitioner is that the statutory appeal preferred by him under Section 10 of the Tamil Nadu Land Encroachment Act, 1905 is yet to be disposed of by the 1st respondent / District Collector. Thus, the present Writ Petition came to be instituted.

2.The appeal has been preferred on 09.01.2024 and 1 1⁄2 years have already been lapsed. That being so, the 1st respondent shall consider the appeal by 2/4

following the procedures as contemplated under the Act and dispose of the same on merits and in accordance with law as expeditiously as possible. 3.With the above observation, this Writ Petition is disposed of. No costs. Consequently, connected miscellaneous petition is closed.
