ORDER

Heard Mr.R.Venkatesan, learned counsel for the petitioner and Mr.T.Amjad Khan, learned Government Advocate, for the respondents. 2.This Writ Petition has been filed for a direction to the 2nd and 3rd respondents to conclude the proceedings in Tha.Pa d1(1)/Tha.pa 119/2020.

3. By consent of both parties, this Writ Petition is taken up for final disposal at the stage of admission itself.

4. The petitioner is working as a Police Constable on 09.06.1993. Now he is working as Head Constable at Singampunari Police Station, Sivagangai from 08.02.2024. While in service, a charge memo in Tha.Pa.d1(1)/Tha.pa.119/2020, dated 06.11.2020 has been issued by the 2nd respondent under Rule 3(b) of TNPSS(D&A) Rules, 1955. The 3rd respondent was appointed as the Enquiry Officer. The petitioner has met with an accident and sustained grievous injury. Thereafter, he gave a mercy petition to drop the further proceedings in Tha.Pa.d1(1)/Tha.pa.119/2020, dated 06.11.2020. However, the same was not considered. Due to pendency of the disciplinary 2/5

proceedings, he was not considered for the upgradation as Special Sub Inspector of Police. Hence, this petition came to be filed.

Considering the facts and circumstances of the case, there shall be a direction to the respondents to conclude the disciplinary proceedings in in Tha.Pa.d1(1)/Tha.pa.119/2020, dated 06.11.2020, on its own merits and pass orders in accordance with law, within a period of four weeks from the date of receipt of a copy of this order. It is made clear that this Court has not gone into the merits of the case or the claim of the petitioner and it is open to the respondents to consider the same on its own merits.

6. With the above direction, this Writ Petition is disposed of. No costs.
