Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus directing the respondents 1 to 5 to take necessary action against the respondents 6 to 9 for purposely and knowingly misused the Government official power for the personal gain and transferred the patta illegally by violating the Act and Rules on the basis of Petitioner's representation, dated 11.4.2025 and consequently direct he official respondents to restore the patta in respect of the property in S.F.No.803/10, situated at Mullankurichi South Village, Karambakudi Taluk, Pudukkottai District. O R D E R

The Petitioner herein seeks a direction to the respondents 1 to 5 to take necessary action against the respondents 6 to 9 and to restore the patta in respect of the property in S.F.No.803/10, situated at Mullankurichi South Village, Karambakudi Taluk, Pudukkottai District in the name of the Petitioner and his siblings. 2.Mrs.K.Malathi, learned Additional Government Pleader takes notice for the respondents 1 to 5. By consent of both parties, the Writ Petition is taken up for final disposal at the admission stage itself. 3.According to the Petitioner, the subject property with an extent of 0.05.51 ares originally belongs to the Petitioner's father Innasi and he died intestate in the year 2005. After the death of the Petitioner's father, the subject property belongs to the Petitioner, her sister and her brother . However, the respondents 6 and 7 transferred the patta in the name of 3/7

Petitioner's brother Ealiyas exclusively. Therefore the Petitioner submitted a representation seeking restoration of patta in the name of all the legal heirs of Innasi and to take necessary action against the respondents 6 and 7 for transferring the patta exclusively in the name of one of the legal heirs of Innasi. The same has not been considered till date. Hence the Petitioner has come before this Court with the present Writ Petition for the relief stated supra.

4.Mrs.K.Malathi, learned Additional Government Pleader, who takes notice for the respondents 1 to 5 would submit that representation submitted by the Petitioner will be considered in accordance with law, within the time stipulated by this Court.

5.In view of the same, without expressing any opinion on the merits of the matter, the fourth respondent is directed to consider the representation submitted by the Petitioner on 11.04.2025 and pass orders on its own merits after issuing notice to the Petitioner and other interested parties, if any, within a period of 12 weeks from the date of receipt of a copy of this order.

In case, the fourth respondent decides to proceed against the respondents 6 and 7, it is needless to say that they must be heard. 6.With the above directions, the Writ Petition stands disposed of. No costs.
