Respondents (R3 impleaded vide order dated 19.09.2019 in WMP(MD)No.16487/2019) Prayer : This petition is filed under Article 226 of Constitution of India, to issue a Mandamus, directing the respondents particularly the 2nd Respondent to provide adequate Police protection as well permission to celebrate the Kodai Festival of Sri Arulmighu Ramasamy Thirukoil at Nadupoolankulam, Poolankulam Village, Alangulam Tk, Tirunelveli District on 29.09.2019 to 02.10.2019 forthwith in pursuance of the petitioner's representation dated 05.08.2019. (In both W.Ps) For Petitioner : Mr.S.Palani Velayutham For R1 & R2 : Mr.R.Anandharaj Additional Public Prosecutor For R3 : Mr.B.Anandan COMMON ORDER These Petitions have been filed to direct the respondent police to provide adequate police protection and to grant permission to celebrate the kodai vizha festival in the petitioners' respective temples.
2.By consent, the writ petitions are taken up for final disposal.
3. Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor appearing for the respondent police and the learned counsel for the third respondent. 4.In view of the facts and circumstances of the case, the petitioner is directed to participate in the enquiry to be conducted by the second respondent on the date fixed by the second respondent. The second respondent is directed to consider the representations submitted by the petitioner in both writ petitions and conduct due enquiry, after issuing notice to all the rival parties and also after giving opportunity of hearing to all the parties and pass orders in accordance with law forthwith, in view of the order passed by this Court in W.P.(MD)No.19972 of 2019 on 17.09.2019.
5. With the above directions, these Writ Petitions are disposed of. No costs.
