PRAYER: Criminal Revision Case is filed under Section 397 r/w 401 of the Criminal Procedure Code, to call for the records of the Principal Sessions Judge, Ramanathapuram in Cr.M.P.No.3445 of 2021 dated 20.01.2022 and modify the condition No.1, to produce one blood relative as surety, condition No.2 of Rs.60,000/- (Rupees Sixty Thousand only) 1/5
as costs by way of an individual/collective deposit in favour of the District Legal Services Authority, Ramanathapuram and condition No.6 to produce the original RC Book at the time of furnishing sureties by allowing this revision petition.

ORDER
This revision is filed seeking to modify some conditions imposed by the learned Principal Sessions Judge, Ramanathapuram in Cr.M.P.No.3445 of 2021, dated 20.01.2022.
2.By order dated 20.01.2022, the petitioner was directed to handover the original RC Book before the trial Court and to remit a sum of Rs.60,000/- in favour of the District Legal Services Authority, Ramanathapuram by way of an non refundable deposit in the environmental fund.
3.The learned counsel for the petitioner submitted that the RC 2/5
Book of the petitioner was already mortgaged to a Finance Company and the petitioner is facing financial trouble and hence, he is not in a position to deposit a sum of Rs.60,000/- as directed by the trial Court. 4.Considering the facts and circumstances, this Court is of the view that the conditions imposed upon the petitioner by the trial Court cannot be found fault. However, since the original RC Book of the vehicle is mortgaged in the Finance Company, a Xerox copy of the same duly certified by the Finance Company, to which the it was mortgaged, shall be produced before the trial Court. Except this modification, the other conditions imposed by the trial Court remain unaltered. 5.Accordingly, this Criminal Revision Case is partly allowed.
