COMMON ORDER : The Court made the following order:- The petitioners, who are arrayed as A4, A7, A10, A11, A12, A14 and A15 apprehending arrest at the hands of the respondent police for the offences punishable under sections 147, 148, 341, 294(b), 323, 324, 427, 355 and 506(ii) IPC, in Crime No.42 of 2022 on the file of the respondent police, seek anticipatory bail.
2.The petitioners are facing the charges for the offences under sections 147, 148, 341, 294(b), 323, 324, 427, 355 and 506(ii) IPC. 1/3
3.Seeking anticipatory bail, the petitioners are before this court.
4.Heard both sides.
5.Even though the allegations are serious nature, the accused assaulted the Panchayat President, who was also present in the place of occurrence, while eviction process was undertaken by the revenue officials, thinking that the de-facto complainant is responsible for the above said eviction process, these persons alleged to have made damage to the vehicle. But however, the identity of the persons involved in the occurrence is a matter for investigation. In this case, similarly placed person like that of the petitioners have been granted anticipatory bail by the Principal District Judge, Sivagangai. So the petitioners, who are also standing on the very same footing are also entitled for anticipatory bail. 6.
Considering the above facts and circumstances of the case, this court in inclined to grant anticipatory bail to the petitioners with certain conditions. Accordingly, the petitioners are ordered to be released on bail in the event of arrest or on their appearance before the learned Judicial Magistrate No.1, Sivagangai and on each of them executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and the petitioners shall appear before the respondent police daily at 10.30 am until further orders. The petitioners shall comply with the condition stipulated under Section 438 Cr.P.C. scrupulously.
The petitioners shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail will stand dismissed. sd/- 12/08/2022 / TRUE COPY / /09/2022 Sub-Assistant Registrar (C.S.)
