PRAYER: Criminal Original Petition filed under Section 482 r/w. Section 439 of Cr.P.C., to modify the condition imposed by the Principal District Sessions Judge, Thanjavur District in Crl.M.P.No.2321 of 2021, dated 17.06.2021, in which, instead of directing the petitioners "to report before the respondent police, daily at 10.00 am., for a period of 15 dyas", it may be modified to the effect that "petitioners shall report before the Judicial Magistrate, Thiruvidaimaruthur, daily at 10.00 am., for a period of 15 days".

O R D E R

This Petition is filed to modify the condition imposed by the Principal District Sessions Judge, Thanjavur District, in Crl.M.P.No.2321 of 2021, dated 17.06.2021, in which, instead of directing the petitioners "to report before the respondent police, daily at 10.00 am., for a period of 15 days", to the effect that "petitioners shall report before the Judicial Magistrate, Thiruvidaimaruthur, daily at 10.00 am., for a period of 15 days".

2. The learned counsel for the petitioner submitted that the petitioner is an accused in the case in Crime No.529 of 2021 for the alleged offences under Sections 294(b), 353, 506(ii) I.P.C. r/w. Section 4(1) (a) of TNP and Transport Act. He further submitted that while granting anticipatory bail to the petitioner, the learned Principal District Sessions Judge, Thanjavur District, imposed a condition that the petitioner shall appear before the respondent police, daily at 10.00 am., for a period of 15 days. Crl.O.P.(MD).No.14039 of 2021 petitioner is a practicing Advocate at Kumbakonam and he has to travel 20 Kms for complying with the condition and he found it very difficult to comply with the same, therefore, he seeks for modification to report before any other Police Station or the Judicial Magistrate, Thiruvidaimaruthur.

3.Heard learned Government Advocate (Crl. Side) appearing for the respondent.

4. Considering the submissions made by the learned counsel appearing for the petitioner that the petitioner is a Practicing Advocate and he has to travel 20 Kms. for complying with the condition, this Court is inclined to allow this petition.

5. Hence, this Criminal Original Petition is allowed and the condition imposed by the Principal District Sessions Judge, Thanjavur District, dated 17.06.2021, in Crl.M.P.No.2321 of 2021, is fully relaxed.
