2. The impugned penalty order was passed under Section 271(1)(b) of the Income Tax Act. Since alternative remedy is available to the petitioner, the writ petitions would not lie. Therefore, the writ petitioner is directed to file an appeal before the appellate authority within a period of four (4) weeks from the date of receipt of a copy of this order. The respondents shall not take coercive steps until the appeal is preferred. The rights of the parties will be determined after the disposal of the appeal.

3. With the above direction, the Writ Petitions are disposed of. There shall be no order as to costs. Consequently, connected miscellaneous petitions are closed.
