ORDER

The petitioner, with a grievance that one Syed Mohammed, who is an Ex-Counselor, is posing threat to the petitioner and attempting to evict him from the house, has filed this petition seeking police protection. 2.The learned counsel appearing for the petitioner submits that the petitioner received money from the said Syed Mohammed and he has repaid the same. However, the money lender had not returned the documents. With these documents, the money lender has attempted to evict the petitioner from his house and therefore, he lodged a complaint and the respondent Police has not provided any protection to the petitioner and hence, he filed the present petition. 3.The learned Government Advocate(Crl.side) appearing for the respondents submits that based on the complaint of the petitioner, petition enquiry was initiated in CSR.No.158 of 2025. The petitioner has executed unregistered sale agreement in favour of the said Syed Mohammed by receiving a sum of Rs.32,00,000/- and he has also borrowed money from one Raja Mohamed and executed another sale 2/5

agreement for the same property. Since it is civil dispute, the respondent Police closed the enquiry.

4.This Court has considered the submissions made on either side and perused the available materials.

5.Admittedly, the petitioner has borrowed money from Syed Mohammed and he claims that he returned the money, however, the said Syed Mohammed has not returned the documents. The petitioner has to workout her remedy before the civil Court and the respondent Police has nothing to do with the same. If the petitioner has been assaulted, then, it is always open to her to lodge a separate complaint. The respondent Police is directed to furnish a copy of the closure report to the petitioner enabling her to workout her remedy in the manner known to law.
