PRAYER : Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Mandamus, directing the respondents to remove the endorsement directing the petitioner to pay deficit stamp duty and other charges for further transaction in the online portal of the respondents website in view of the No Due Certificate issued by the 2nd respondent on 10.12.2019 in respect of Document No.1201/2019, dated 12.09.2019 in respect of petitioner's land located in SF No.42/B3 in Patta No.231 at K. ORDER
The present Writ Petition has been filed for the issuance of a Writ of Mandamus directing the respondents to remove the endorsement in the online portal of the respondents website.
2. The petitioner had registered a sale deed with deficit in stamp duty. Consequently, proceedings were initiated under Section 47-A of the Indian Stamp Act, 1899, as applicable to Tamil Nadu, read with the Tamil Nadu Stamp (Prevention of Under-Valuation of Instruments) Rules, 1968. Pursuant to the order passed under Section 47-A, the appropriate stamp duty was duly paid. As on date, there is no outstanding liability in respect of stamp duty or any related fees. However, the respondents have failed to remove the endorsement reflecting the deficit stamp duty on their official online portal.
3. In view of the above facts, the respondents are directed to remove the said endorsement from their online portal within a period of three weeks from the date of receipt of a copy of this order.
