ORDER
This criminal original petition has been filed seeking a direction to give police protection to the petitioner's life and limb on the basis of the petitioner's representation, dated 01.07.2019.
2.The grievance of the petitioner is that he is the owner of the property. According to him, the second respondent forged some documents in respect of the land belongs to the petitioner. Hence, he filed a complaint against him. Based on which F.I.R. has been registered in Crime No.19 of 2016 and investigation is pending. Pending investigation, now on 01.07.2019, the second respondent along with rowdy elements came to the petitioner's property and threatened him and hence the petitioner appears before the first respondent seeking police protection to him, the same has not been considered so far, the petitioner has come forward with this present petition.
3.The learned Government Advocate (Crl. Side) appearing for the first respondent on instructions would submit that earlier based on the complaint given by the petitioner, F.I.R. has been registered in Crime No.19 of 2016. Pending investigation, once https://hcservices.ecourts.gov.in/hcservices/ 1/2
Crl.O.P.(MD).No.11253 of 2019 again the petitioner has filed another complaint as if the second respondent trying to attack the petitioner. Based on the complaint, enquiry has been conducted with the neighbours of the petitioner and they have given a statement that no such occurrence has taken place as stated by the petitioner. Hence, the complaint given by the petitioner has been closed. It is also stated that civil suit is pending between the parties.
4.Since, already petition enquiry has been closed as no such occurrence is taken place and a civil suit is pending between the parties, this criminal original petition is dismissed.
