ORDER

(Order of the Court was made by DR.G.JAYACHANDRAN, J.) One Aran Pani Arakattalai, claiming to be a Village Association involved in literary and spiritual service, believes that the Chola King, Rajarajan, was buried at Udayalur, Kumbakonam Taluk, Thanjavur District and with their own funds, they wanted to construct a monument in that place.

The seventh respondent / Executive Officer of Arulmigu Kailasanthar Temple, Udayalur Village, Kumbakonam Taluk, states that Survey Nos.70/5, 70/6 and 71/1 in Udayalur Village, Kumbakonam Taluk, belongs to the Temple. It is leased out to a cultivating tenant and agricultural activities are going on in that field. There is a Sivalingam in that field, but, there is no historical or scientific evidence to show that the late King, Rajarajan, was buried in the said place, except some literature references.

3. This Court, on perusing the pleadings, find that the belief of the petitioner Association has no scientific basis. In the said circumstances, the prayer sought for in this writ petition cannot be entertained. If in future, there is any material to show that late Chola King Rajarajan was buried in a particular place and the Government, at that point of time, take a policy decision, that a monument should be erected for the late King Rajarajan. It is for the Government to take up the appropriate policy decision and a judicial order cannot be passed in this matter.

4. Hence, this writ petition stands disposed of. There shall be no order as to costs.
