Respondent PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, praying for issuance of a writ of mandamus, directing the respondent to issue separate Patta in the name of the petitioner, by considering the petitioner's application, dated 17.04.2025, and representation, dated 05.05.2025, submitted by the petitioner to the respondent in respect of the property comprised in Survey Number 578/1A with an extent of 1312 1⁄2 Sq.feet, which is situated in Shanmugasundarapuram Village, Andipatti Subdivision, Periyakulam, Theni District.

ORDER

The petitioner herein seeks a direction to the respondent to issue separate patta in his name, by considering his application, dated 17.04.2025, and representation, dated 05.05.2025.

2. According to the petitioner, he purchased 1312 1⁄2 sq.ft. of land in Survey No.578/1A at Shanmugasundarapuram Village, Andipatti Subdivision, Periyakulam, Theni District. Though he applied for issuance of separate patta based on a sale deed, he was issued with only joint patta. Therefore, he submitted a representation on 05.05.2025 before the respondent, seeking issuance of separate patta, based on his sale deed. The same has not been considered. Hence, he has come before this Court.

3. The Additional Government Pleader, who takes notice for the respondent, would submit that there is a shortage of extent as available on ground and, therefore, the petitioner's request for issuance of separate patta has not been processed.

4. In view of the above, without expressing any opinion on the merits of the claim made by the petitioner, the respondent is directed to consider the representation of the petitioner, dated 05.05.2025, and pass final orders on its own merits within a period of eight weeks from the date of receipt of copy of this order.

5. Accordingly, the Writ Petition is disposed of. No costs. 24.06.2025 NCC :
