O R D E R

(Order of the Court was made by C.V.Karthikeyan, J.) This petition has been filed expressing grievance that the son of the petitioner, aged about 28 years Rajendran, has been missing on and from 21.11.2024. It had been stated that he went out of the house on that day and did not come back. The petitioner had contacted his mobile number, but it was switched off. He had also searched in the vicinity in and around the village. Thereafter, he had lodged a complaint on 27.12.2024 and the 4th respondent had registered the FIR in Crime No. 232 of 2024 under the caption "man missing". Stating that no progress had been made in the investigation, this Habeas Corpus petition had been filed.

The learned Additional Public Prosecutor, on instructions, stated that much earlier on 26.11.2024, a dead body had been recovered from inside a well in the vicinity of the jurisdiction of the 4th respondent police and in that connection FIR in Crime No.223 of 2024 had been registered on 26.11.2024 for death under suspicious circumstances. Thereafter, the FIR registered under the caption "man missing" was also taken on file and suspecting the retrieved body to be that of the missing son of the petitioner, the investigating officer had conducted DNA test and it is informed that DNA profile had been received that it matches with the petitioner. A reasonable conclusion and inference had therefore been drawn that the body which had been recovered is that of the missing son of the petitioner.

It is contended that therefore further investigation will have to be done regarding the circumstances under which Rajendran had met his fate and investigation is proceeding further in FIR in Crime No.223 of 2024. In view of the fact that the body had been recovered and DNA profile shows that it reasonably could be inferred it is the son of the petitioner herein, FIR in Crime No.232 of 2024 can be closed and further investigation could be done in FIR in Crime No.223 of 2024.

3. In view of the above facts, no further directions are required in this Habeas Corpus Petition and accordingly, the same stands closed.
