P.C, praying to this Court to relax the condition imposed on the petitioner in Crl.A(MD) No.331 of 2021 dt. 31/08/2021 in Crime No.72 of 2021 on the file of the Respondent Police Prayer in CRL A(MD). 331/ 2021 :- This Appeal filed under section 14-A(2) of SC/ST (POA) Act, 1989 against the order of the Sessions Judge, Special Court for Exclusive Trial of cases under SC/ST (POA) Act, Sivagangai, dated 30.07.2021 made in CRL MP.No. 837/2021 and to enlarge the Appellant on bail in Crime No. 72 of 2021 pending investigation of the file of the 1st respondent of Police.
ORDER:- This Petition coming on for hearing on this day and upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of Mr. R. Udhayakumar, Advocate for the Petitioner and of M. Muthumanikkam, Counsel for Government of Tamil Nade (Criminal Side) for the 1 & 2 respondents and of Mr. G. Bhagavath Singh, Advocate for the 3rd respondent, this Court made the following order:
This petition has been filed to relax the condition imposed on the petitioner in Crl.A(MD)No.331 of 2021, dated 31.08.2021 in Crime No.72 of 2021.
2.Mr.R.Udhayakumar, learned counsel appearing for the petitioner would state that while granting bail, this Court imposed a condition that the petitioner/Appellant shall stay at Madurai and report before the Inspector of Police, Tallakulam Police Station, daily at 10.30 a.m., and 05.00 p.m., until further orders and the petitioner has been complying with the condition from 03.09.2021. It is further stated that in view of the condition imposed on the petitioner, he is not able to go for regular work and earn for his livelihood and hence, his entire family is suffering.
3. Mr.M.Muthumanikkam, learned Government Advocate appearing for the State Government would submit that the petitioner has been complying with the condition regularly from 03.09.2021.
4. In the light of the above fact, the condition imposed on the petitioner in Crl.A(MD)No.331 of 2021, dated 31.08.2021 is modified to the effect that the petitioner is directed to appear before the learned Sessions Judge, Special Court for Exclusive Trial of Cases under SC/ST (POA) Act, 1989, Sivagangai on the first working day of every month at 10.30 a.m., until further orders.
5. Accordingly, this petition is ordered.
