ORDER

This writ petition has been filed seeking for a direction to the 1st respondent to give an appropriate direction to the 3rd respondent not to involve in the civil dispute based on the representation dated 05.05.2026, within a time frame fixed by this Court.

2. The learned counsel appearing for the petitioner submitted that the petitioner is running a real estate company. However, on certain complaint receive from miscreants, the 3rd respondent police is harassing. He also pointed out that it is all a business transaction, and the police has no duty to meddle in civil matters and hence sought the indulgence of this Court.

The learned Government Advocate appearing for the respondent police submitted that, upon receipt of several complaints against the petitioner, a discreet enquiry had already been conducted, pursuant to which an FIR in Crime No.286 of 2023 came to be registered. It was further submitted that enquiries in respect of complaints lodged by several other persons are also pending. According to the learned Government Advocate, the present petition has been filed only with a view to shield the petitioner from the criminal prosecution already initiated against him on allegations of having cheated several customers in the course of his real estate business. 2/4

4. Heard the learned counsel on either sides and carefully perused the materials available on record.

Considering the fact that an FIR has already been registered against the petitioner and that several complaints have been received against him, this Court makes it clear that the petitioner shall extend full cooperation to the enquiry being conducted by the respondent police. At the same time, the respondent police shall not subject the petitioner to any unnecessary harassment. The respondent police are directed to issue summons to the petitioner under Section 64 of BNSS, and thereafter, conduct a discreet enquiry in accordance with law and conclude the same within a period of four weeks from the date of receipt of a copy of this order.

6. With the above direction, this writ petition stands disposed of. 11.06.2026 NCC : Yes / No Index : Yes / No sm 3/4
