2025 in E.P.Nos.9 and 8 of 2025 in RLTOP.Nos.17 and 19 of 2020 dated 06.11.2025.
3.When the matter came up for final hearing before this court, Mr.S.Ramsundar Vijayaraj had represented to this Court that the tenant will vacate and hand over peaceful possession of the property and will also clear the arrears of rent, if sufficient time is granted. This Court granted him time to vacate and hand over peaceful possession on or before 01.06.2026. Consequently, the Civil Revision Petitions were disposed of.
4.In the affidavit of undertaking filed by the contemnor, Mr.Jegan Selvakumar, he had stated that he will vacate the premises situated at D.No.A11, (northern and southern portions), Municipal Colony, Maharaja Nagar, Tirunelveli - 627 011. He sought time till 01.06.2026, being the end of the academic year so as to enable him to wind up the business of student academy being run in the petition mentioned property without any disturbance. Though the undertaking was recorded, it was not complied with. Hence, the landlord attempted to take possession of the property through the process of the court. At that time, she came to know that a sale deed has been registered on 3/7
the file of Melappalayam Sub Registrar Office, Tirunelveli, in Doc.No. 812/1992 and the tenant started claiming that the property belongs to him. Aggrieved by the violation of the undertaking as well as by the subsequent act of creation of records, these contempt petitions were presented to this Court.
5.After being satisfied that there was a violation of the order, I called upon Mr.V.Meenakshi Sundaram to serve the papers on the counsel, who represented the tenant and directed the matter to be listed on 17.06.2026.
6.On 17.06.2026, Mr.Veera Kathiravan, Senior Counsel, appearing for Mr.S.Ramsundar Vijayaraj urged that the tenant is proposing to file review petitions to review the common order passed by this Court dated 28.11.2025 in the revisions. I pointed out to Mr.Veera Kathiravan that unless and until, the order recording the undertaking is set aside or reversed or kept in abeyance, it is the duty of the contemnor to comply with the terms of the undertaking. I had no other option than to come to the conclusion that every minute that the contemnor continues in possession after the period granted under the undertaking has expired is ex-facie contemptuous. At that stage of 4/7
the proceedings, Mr.S.Ramsundar Vijayaraj stated that the contemnor will hand over the possession immediately. Hence, I adjourned the matter to today.
7.When I took up the matter, Mr.S.Ramsundar Vijayaraj has handed over the keys for the properties covered under the execution petitions. The same has been duly received and acknowledged by Mr.V.Meenakshi Sundaram. The contemnor has further agreed to transfer the arrear amount of Rs.70,000/- to the landlord's account forthwith.
8.The contemnor is present in Court. As he has set right the contemptuous situation created by him and as he has realized and repented the consequences of violation of the undertaking, these Contempt Petitions are ordered in the following terms:- i) Contempt is made out as against the respondent for having violated the undertaking affidavit that he has filed and recorded by this Court. He is found guilty.
ii) As he has come forward within a period of two weeks and has handed over the possession and has also agreed to transfer the arrears of rent, instead of punishing him with imprisonment, a fine for 5/7
a sum of Rs.1,000/- is imposed on him. The Registry of this Court shall receive the same and remit it to the account bearing No. 6988563932, in the name of Education and Training to Visually Impaired Person.
iii) Mr.S.Ramsundar Vijayaraj shall file proof of payment of fine to the Registry of this Court by 22.06.2026.
