PRAYER: Criminal Original Petition filed under Section 482 of Cr.P.C, praying to expedite the trail in S.T.C.No. 462 of 2018 pending on the file of the Judicial Magistrate Fast Track Court Magisterial Level, Nagercoil, Kanyakumari District, within stipulated time frame that may be prescribed by this Court.

For Petitioner : Mr.R.Aravindraj C O M M O N O R D E R These criminal original petitions have been filed seeking speedy trial in S.T.C.Nos. 461 and 462 of 2018, pending on the file of the Judicial Magistrate, Fast Track Court (Magisterial Level), Nagercoil, Kanyakumari District.

2.The grievance of the petitioner is that at the stage of defence witness, the accused is dragging the proceedings. The learned Judicial Magistrate, Fast Track Court (Magisterial Level), Nagercoil, Kanyakumari District, is also granting time again and again. Therefore, the proceedings are pending for the past one year at the stage of defence witness. According to him, these complaints were instituted in the year 2018 and pending for the past six years. On verification, it is confirmed that the no NBW is 2/4

pending as against the accused.

3.Considering the said submission, the trial Court in both the cases, is directed to conclude the trial within a period of two months, from the date of receipt of a copy of this order.

4.With the above direction, these criminal original petitions are disposed of.
