ORDER : The Court made the following order :- The petitioners/Accused who apprehend arrest at the hands of the respondent police for the offences punishable under sections 406, 420, 120-B of of I.P.C r/w. Section 5 of Tamil Nadu Protection of Interest of Depositors (Financial Establishment) Act, 1997, in Crime No. 5 of 2023 on the file of the respondent police, seek anticipatory bail.

2. The case of the prosecution as per the de-facto complainant is that the petitioners are the Directors of the Company and thereby, they cheated the amount.

3. Heard both side and perused the materials available on record including the First Information Report.

4. It is seen that the petitioners herein are arrayed as A2 and A3. The first accused and the petitioners are Directors. Sofar, they have cheated Rs.64,70,378/- from 400 victims and the other accused persons were arrested by the police and still in custody. The properties have not yet identified sofar. Therefore, this Court feels that custodial interrogation of the petitioners are very much required. Hence, this court is not inclined to grant https://www.mhc.tn.gov.in/judis 1/2

CRL OP(MD). No.11949 of 2023 anticipatory bail to the petitioners.

5. Hence, this Petition is dismissed.
