PRAYER: Writ Petition is filed under Article 226 of the Constitution of India for the issue of a Writ of Mandamus to direct the third respondent to strictly follow the tender conditions in respect of solvency certificate as per Column No.3 of the public auction cum tender notice dated 08.01.2016 and to conduct auction cum tender by receiving separate caution deposit for public auction and tender in accordance with Circular issued by the first respondent in Na.Ka.No.53114/2008/R2 dated 04.02.2009. ORDER

Mr.A.Muthukaruppan, learned Additional Government Pleader takes notice for the respondents 1 and 2 and Mr.G.Arjunan, learned Counsel takes notice for the third respondent.

2. The petitioner seeks for a Mandamus directing the third respondent to strictly follow the tender conditions in respect of solvency certificate as per Column No.3 of the public auction cum tender notice dated 08.01.2016 and to conduct auction cum tender by receiving separate caution deposit for public auction and tender in accordance with Circular issued by the first respondent in Na.Ka.No.53114/2008/R2 dated 04.02.2009. https://hcservices.ecourts.gov.in/hcservices/

3. Mr.G.Arjunan, learned Counsel who takes notice for the third respondent based on instructions submitted that the petitioner's request has already been considered and the Authorities are following the Manual Rules while conducting public auction.

4. The above submission is recorded and the writ petition is closed. Consequently, the connected Miscellaneous Petition is also closed. No costs.
