PRAYER: Writ petition filed under Article 226 of the Constitution of India, to issue a Writ of Certiorari, calling for the records of the 1st respondent in the proceedings in I.D.No. 112/2014 dated 25.02.2016, quash the same.

O R D E R

The second respondent herein was discharged from service by the management on 04.02.2000. The second respondent herein filed I.D.No.112 of 2014 before the Labour Court, Madurai after a period of 14 years on 06.12.2014. The I.D., Act was amended in the year 2010. Any industrial dispute raised beyond the period of 3 years is obviously hit by limitation. In fact, the Labour Court itself, has no jurisdiction to entertain the dispute. The impugned award passed by the Labour Court, Madurai is thus hit by limitation. 2.In this view of the matter, the award impugned in this writ petition dated 25.02.2016 is set aside. Accordingly, the writ petition is allowed. No costs. Consequently, the connected miscellaneous petition is closed.
