This petition has been filed to transfer the investigation in Crime No.19 of 2019 from the file of the second respondent to the file of the 4th respondent.
2. The learned Government Advocate (Crl.side) appearing for the respondents submitted that after registering the complaint the case was registered in Crime No.19 of 2019 for the offences under Sections 406, 420, 506(ii), 34 of IPC., and 4 of the Tamil Nadu Prohibition of Harassment of Women Act 2002. He further submitted that the respondent police has conducted roving investigation and recorded the statements from the witnesses. Crl.O.P(MD).No.11767 of 2019 Therefore, at this stage, if the investigation is transferred to any other agency, the entire investigation would be affected.
3. Considering the above facts and circumstances of the case, the transfer of investigation cannot be considered. However, the third respondent is directed to complete the investigation and file a final report, within a period of twelve weeks from the date of receipt of a copy of this order. The first respondent is also directed to monitor the investigation done by the third respondent and shall ensure that the third respondent shall comply the order passed by this Court.
4. With the above direction, this Criminal Original Petition is disposed of.
