To call for records in S.S.C.No.55 of 2019 on the file of the Sessions Judge, Special Court for exclusive trial of cases under POCSO Act, Madurai and set aside the conviction passed by judgment dated 13.10.2020 passed. Order : This petition coming up for orders on this day, upon perusing the petition filed in support thereof and upon hearing the arguments of M/S.KARUPPASAMY PANDIYAN G, Advocate for the petitioner and of M/S.M.SAKTHI KUMAR, Government Advocate(Crl.side) on behalf of the Respondent the court made the following order:- 1/3

This Criminal Miscellaneous Petition has been filed to relax the condition imposed on the petitioner in Crl.M.P(MD)No.6768 of 2023 in Crl.A(MD) No.336 of 2020 dated 12.05.2023.

2. According to the petitioner he has been complying with the condition from 22.05.2023 and due to the above said condition he is suffering a lot and he is not able to go for job for his avocation.

3. The learned Government Advocate(Crl.Side) appearing for the respondent also admitted that the petitioner has been complying with the conditions without fail as directed by this Court.

4.Considering the representation made by the learned counsel appearing for the petitioner and the learned Government Advocate(Crl.Side) and also considering the nature of offence and considering that the petitioner is complying with the condition without fail, I am inclined to modify the conditions. Accordingly, the condition imposed on the petitioner is modified to the effect that the petitioner shall report before the trial Court @ 10.30 a.m., on the first working day of every English Calendar month until further orders.
