Respondents PRAYER: Writ Petition is filed under Article 226 of Constitution of India for issuance of Writ of Mandamus, directing the respondents to disburse the subsidy to the members of the society through the petitioner's society under the supervision of the 3rd respondent by considering the representation of the petitioner dated 17.11.2020, within a time frame that may be fixed by this Court. ORDER
(This Matter was heard through the Video Conference) This writ petition has been filed for a Mandamus seeking for a direction to the respondents to disburse the subsidy to the members of the society through the petitioner's society under the 1/3
supervision of the third respondent by considering the petitioner's representation dated 17.11.2020, within a time frame to be fixed by this Court.
2.Heard Mr.S.C.Herold Singh, learned Counsel for the petitioner and Mr.C.Ramesh, learned Special Government Pleader, who accepts notice on behalf of the respondents.
3.By consent of both parties, this writ petition is taken up for final disposal at the admission stage itself. 4.It is the case of the petitioner society that they represent the interest of the Bee keepers in Kanniyakumari District. According to them, the members of the petitioner society are entitled to get subsidy from the Government. They have given a representation to the second and third respondents, on 17.11.2020 seeking for subsidy for their members. According to them, till date, the said representation has not been considered. In such circumstances, this writ petition has been filed. 5.The relief sought for in this writ petition is an innocuous relief. No prejudice will be caused to the respondents, if the representation of the petitioner dated 17.11.2020, is considered by them, on merits and in accordance with law.
The petitioner represents the society representing the interest of Bee keepers at Kanniyakumari District. They claim that they are entitled for subsidy under Government scheme. They have given a representation on 17.11.2020 for the said purpose. It is for the respondents to consider the same on merits and in accordance with law. 6.For the foregoing reasons, this Court directs the second and third respondents to consider the petitioner's representation dated 17.11.2020, seeking for disbursement of subsidy to the members of the petitioner's society through the petitioner society under the supervision of the third respondent and pass final orders on merits and in accordance with law, within a period of eight weeks from the date of receipt of a copy of this order.
7.With the aforesaid direction, this writ petition is disposed of. No costs.
