ORDER : The Court made the following order :- https://www.mhc.tn.gov.in/judis The petitioners/Accused, apprehending arrest at the hands of the respondent police for the alleged offence punishable under
Sections 294(b), 323, 506(i) I.P.C and Sections 3(1)(4) of Dowry Prohibition Act, in Crime No.13 of 2022, on the file of the respondent police, seek anticipatory bail.
2. The case of the prosecution is that the first petitioner married the defacto complainant on 29.04.2021 and after marriage, the accused persons demanded dowry and harassed her. Hence, the complaint.
3. On the side of the petitioners, it is stated that the petitioners are innocent and they had not committed any such offence, as alleged by the prosecution. They are no way connected with the offence. Hence, prays to release them on anticipatory bail.
4. On the side of prosecution, it is stated that the first petitioner is the husband of defacto complainant, second petitioner is the sister's husband of first petitioner, third and fourth petitioners are sisters of A1 and fifth petitioner is the brother of first petitioner. The accused persons demanded dowry and harassed the defacto complainant. Investigation is not yet completed and hence, prayed to dismiss the petition.
5.Considering the gravity of the offence, the overt act attributed against the petitioners and the nature of serious allegations, this Court is not inclined to grant anticipatory bail to them.
6. Accordingly, this Criminal Original Petition stands dismissed.
