PRAYER : Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Certiorarified Mandamus, calling for the records relating to the impugned refusal check slip No. RFL/Thiruverumbur/156/2025 dated on 16.05.2025 of the 2nd respondent and quash the same as illegal and consequently directing the 2nd respondent to register the settlement deed presented by the petitioner for registration within the period that may be stipulated by this Court.

ORDER

The present Writ Petition has been filed for the issuance of a Writ of Certiorarified Mandamus to quash the impugned refusal check slip dated 16.05.2025 and consequently direct the 2nd respondent to register the settlement deed.

2. The respondents have contended that the disputed land belongs to the WAKF Board. In case, if the land belongs either to the HR & CE Department or the WAKF Board, the 2nd respondent is bound to conduct an enquiry in accordance with the order passed in the case of Sudha Ravi Kumar and Another vs. The Special Commissioner and Others in W.P. Nos. 30589 of 2013 and batch, dated 05.04.2017.

3. Therefore, the 2nd respondent is directed to issue notice to the 1st and 3rd respondents, and thereafter conduct an enquiry and pass appropriate orders, in accordance with law, within a period of four weeks from the date of receipt of a copy of this order.

4. With these observations, this writ petition is disposed of. No Costs.
