ORDER
This Criminal Original Petition is filed for a direction to the learned Judicial Magistrate, Melur, to dispose of C.C.No.37 of 2019 within a specific time stipulated by this Court.
2. It is submitted by the learned counsel for the petitioner that a case has been filed in C.C.No.37 of 2019 against the petitioner for the offences under Sections, 279, 337 of IPC altered to 304(A) of IPC, wherein the prosecution has cited 10 witnesses and out of them, the prosecution stated to have examined 9 witnesses expect the investigation officer. The matter is posted for time to time for the last more than seven months, for the examination of the investigation officer. Therefore, the petitioner sought for a direction for early disposal.
3. The learned Government Advocate (Crl.side) has reported that the investigating officer, supposed to be examined in C.C.No.37 of 2019, has been removed from service on account of some charges and thereby, which become difficult to secure the person. The learned Government 2/4
Advocate (Crl.side) assured that he would present the witness before the Court.
4. The learned Judicial Magistrate, Melur, is also requested to explore the possibility of directing the prosecution to produce some other police officer who can identify the signature of the investigation officer, so that he will explain about the nature of investigation conducted by the investigation officer. The learned Judicial Magistrate, Melur, is further directed to complete the examination of the investigation officer and close the case as expeditiously as possible, not later than within a period of three months from the date of receipt of a copy of this order.
5. With the above observations, this Criminal Original Petition is closed.
