Crl.A.No.58 of 2017 dated 09.12.2022 in S.C.No.317 of 2008 dated 24.08.2017 on the file of the learned Principal Assistant Sessions Court, Tirunelveli District and duly set aside the same.

Order : This criminal miscellaneous petition coming up for orders on this day, upon perusing the petition filed in support thereof and upon hearing the arguments of M/s.MAHESWARAN R, Advocate for the petitioner and of Mr.B.THANGA ARAVINDH, Government Advocate (Crl. side) on behalf of the Respondent, the Court made the following order:- This petition has been filed to modify the condition No.iii of the order dated 23.02.2024 passed by this Court in Crl.M.P.No.18102 of 2023 in Crl.R.C(MD)No.50 of 2023.

2. The learned counsel for the petitioner Mr.R.Maheswaran and learned Additional Public Prosecutor appearing for the respondent police are present before this Court.

3. The learned counsel for the petitioner submitted that the petitioner has been complying with the condition imposed by this court regularly.

4. The learned Government Advocate (Crl.Side) submitted that the petitioner has been complying with the condition regularly.

5. Considering the nature and the gravity of offence, the condition imposed by this court in Crl.M.P.No.18102 of 2023 in Crl.R.C(MD)No.50 of 2023 dated 2/4

23.02.2024, is modified and the petitioner shall report before the concerned trial Court on the first working day of every English calendar month at 10.30 a.m., until further orders.
