ORDER

This Criminal Original Petition is filed to direct the first respondent to withdraw the Investigation in Cr.No.158/2024 on the file of the fourth respondent and transfer the same to third respondent or to some other agencies and conduct the fresh investigation by considering the petitioners representation dated 9.3.2024. 2.Learned counsel for the petitioner submitted that the petitioner is the defacto complainant, on whose complaint a case in Crime No.158 of 2024 was registered by the fourth respondent. Since there is no progress in the investigation, seeking transfer of investigation from the fourth respondent to the third respondent, this petition came to be filed. 2/4

The learned Government Advocate, on instructions, would submit that the investigation has been completed and a final report has also been filed before the Judicial Magistrate, Melur, through online in E-Filing No.PRC LTN20220001677 C202400141/2024 on 07.08.2024. However, it has not been taken on file.

4. In view of the above, the Judicial Magistrate, Melur, is also directed to take the case on file forthwith. This Criminal Original Petition is closed, with liberty to the petitioners to challenge the final report, by filing a petition seeking further investigation under Section 173(8) Cr.P.C., / 193 (9) BNSS, 2023, if not satisfied by the manner in which final report is filed. Consequently, connected miscellaneous petition is closed.
