ORDER
The petitioner herein seeks a direction to the third respondent to complete the enquiry and submit a report before the second respondent, as per the proceedings of the second respondent in O.Mu.No. 8517/2024/A2 dated 24.12.2024.
2.Heard the arguments of M/s.G.Dhanaseeli, learned counsel appearing for the petitioner and Mrs.K.Malathi, learned Additional Government Pleader appearing for the respondents. By consent of both sides, this Writ Petition is taken up for final disposal at the admission stage itself.
3.According to the petitioner, the property in Survey No.1655/2A & 2C in Andipatti Bit-2 Village, Andipatti Taluk, Theni District, has been in possession and enjoyment of the petitioner and his brother,
Rathinaswamy. However, one Kannammal obtained a UDR patta in her favour and created a document based on the patta. Hence, the petitioner submitted a representation before the second respondent on 07.12.2024 seeking cancellation of patta issued in favour of the said Kannammal. The second respondent inturn in his proceedings in O.Mu.No. 8517/2024/A2, dated 24.12.2024, directed the third respondent to conduct an enquiry and submit a detailed report. Inspite of the said direction by the second respondent, the third respondent has not submitted any report. Therefore, the petitioner has come before this court.
4.The learned Additional Government Pleader appearing for the respondents would submit that the enquiry pending before the second respondent will be completed within the time stipulated by this Court. 5.In view of the same, without expressing any opinion on the merits of the matter, the second respondent is directed to complete the enquiry pending on his file within a period of twelve weeks from the date of receipt of a copy of this order, after issuing notice to the petitioner,
the above said Kannammal mentioned in the representation of the petitioner and other interested parties. Accordingly, this Writ Petition is disposed of. No costs.
