Writ Petition is filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Mandamus, directing the second respondent herein to consider and pass appropriate orders on the representation of the petitioner, dated 30.08.2016.

ORDER

Heard the learned counsel for the petitioner and the learned Government Advocate for the respondents.

2.By consent, the Writ Petition itself is taken up for final disposal.

3.The petitioner claimed to be the owner of the property in Survey Nos.630/4, 741/2, 742/5, 759/2, 767/7 and 806/11 situated in Mannavanoor Village, Kodaikanal Taluk, Dindigul District. Out of which, he sold an extent of 6 cents in Survey No.806/11 to one Velayutham. Now, joint patta has been issued along with Velayutham in all other survey numbers, even though he sold the property only respect of Survey No.806/11. In the above circumstances, he has made a representation before the first respondent on 30.08.2016 and the same is pending. Since no order has been passed, the petitioner has https://hcservices.ecourts.gov.in/hcservices/

filed the present Writ Petition.

4.The learned Government Advocate appearing for the respondents submitted that already the first respondent called for report from the second respondent and he will pass appropriate orders.

5.In the above circumstances, the first respondent is directed to conduct enquiry based on the representation given by the petitioner, dated 30.08.2016, after issuing notice to the rival claimants and pass appropriate orders on merits and in accordance with law within a period of twelve weeks from the date of receipt of a copy of this order.

6.With the above direction, this Writ Petition is disposed of. No costs.
