For Respondent : Mr.B. Thanga Aravindh, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.116 of 2022 on the file of the Respondent Police.
ORDER : The Court made the following order :- The petitioner apprehending arrest at the hands of the respondent police for the offences punishable under section 306 IPC., in Crime No.116 of 2022 on the file of the respondent police, seeks anticipatory bail.
2, The case of the prosecution is that the deceased married A1 and that there was continuous torture by mother-in-law and the first accused, who is the husband also did not take care of her properly. At one point of time, the 7th accused threatened her with dire consequences. Again on 21.06.2022, the trouble was made by accused person not to take water from the tape. Because of the above said continuous torture, on 24.06.2022 the deceased set fire on
her. On the basis of the information given by the grand daughter, the defacto complainant went to the Government Hospital, where she found her daughter with burn injuries and subsequently, died on 25.06.2022. Hence, the complaint.
3.The second accused has filed this petition on the ground that A1 has already enlarged on bail by the Principal Sessions Judge, Dindigul in Crl.M.P.No.1914 of 2022 on 04.07.2022 and the other co-accused viz., A4 and A5 have already been granted anticipatory bail by this Court in Crl.O.P(MD).No.11679 of 2022. So far as the Accused Nos.3, 6 and 7 are concerned their names are deleted from the FIR.
4. The learned counsel for the petitioner submitted that there was no trouble between the mother-in-law and the deceased. Even as per the observation that has been made by the learned Principal Sessions Judge, Dindigul, the trouble was created only with regard to taking of water in the tape. He would further submit that the deceased have two children and they have been taken care only by this petitioner.
5. The learned Government Advocate (Crl. Side) appearing for the respondent would submit that the the petitioner herein is the mother-in-law of the deceased and the investigation of the case is pending.
6. On reading of CD file it is seen that there is a continuous torture made by this petitioner to the deceased and only because of that the deceased has committed suicide. When there is specific allegation made against the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner.
7. Accordingly, this Criminal Original Petition is dismissed.
