ORDER

(This petition is heard through video conference) This petition has been filed seeking direction to the 2nd respondent not to harass the petitioner on the basis of a baseless complaint given by the above 3rd respondent.

2.When the matter is taken up for hearing, there is no representation for the petitioner. However, the learned Additional Public Prosecutor submitted that based upon the complaint given by the third respondent herein enquiry was undertaken in CSR No.476 of 2021 and during the enquiry, it was found that it is a money transaction between the parties. The petitioner did not appear before the Enquiry Officer and co-operate with him. The third respondent has appeared before the Enquiry Officer and given a statement to the effect that since it is a money dispute between them he will work out his remedy through civil proceedings. Based upon the undertaking given by the third respondent, the complaint came to be closed on 13.09.2021.

3.Since the enquiry has been closed, question of harassment at the hands of respondent police may not arise. Hence, the prayer https://hcservices.ecourts.gov.in/hcservices/ 1/2

Crl.O.P.(MD).No.14069 of 2021 sought for in this petition has become infructuous and nothing survives for further direction in this petition. Accordingly, this petition is dismissed as infructuous.
