Writ Petition is filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus directing the respondents to appoint the petitioner as a Village Assistant in future based on the petitioner's representation dated 06.09.2016 within the time that may be fixed by this Court. For Petitioner : Mr.N.Balakrishnan For Respondents : Mr.V.R.Shanmuganathan, Special Government Pleader.

O R D E R

This writ petition has been filed by the petitioner, who is allegedly a person, suffering from permanent disability, seeking employment after retirement of his father.

2.Heard the learned counsel appearing for the petitioner and the learned Special Government Pleader, who took notice for the respondents. By consent, the writ petition itself is taken up for final disposal.

3.0.The case of the petitioner is that the petitioner is a physically challenged person with 50% disability. He has studied upto 10th Standard. He belongs to Scheduled Community. He is a person living below the poverty line and he is struggling for his daily livelihood. He has registered himself in the District Employment Exchange Office, Pudukottai.

Village Assistant, which was to be held on 12.01.2015 and accordingly he also attended the interview and submitted his original certificates. Even though, he performed well in the interview, he did not get employment.

3.2.The grievance of the petitioner is that though his father was employed as Assistant to Village Administrative Officer and he retired from service, during the year 2014, the petitioner who gained experience from his father and who performed well, has not been considered for appointment. So stating, a representation has been submitted to the first respondent. As the same was not considered, this writ petition has been filed. 4.The learned Special Government Pleader would submit that it is agreeable for the first respondent to consider the representation of the petitioner and to pass appropriate orders, considering the qualification of the petitioner, and not on the ground that his father worked as Assistant to Village Administrative Officer. 5.Recording the submission made by the learned Special Government Pleader appearing for the respondents, the first respondent is directed to consider the representation of the petitioner dated 07.09.2016 and pass orders on merits and in accordance with law, within a period of four weeks, from the date of receipt of a copy of this order.

6.With the above direction, this writ petition is disposed of. No costs.
