Respondents Prayer: Writ Petition is filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Mandamus directing the third respondent to consider the representation, dated 25.11.2015 and consequently directing the third respondent to cancel the patta record No.2406, dated 22.05.2012 issued in favour of the 6th respondent in respect of Survey No.501/5 and Survey No.652/16A2 measuring to an extent of 0.25.00 hectares and 0.2.00 hectares respectively situated at Rameswaram Town, Ramanathapuram District.

ORDER

Heard the learned counsel for the petitioner and the learned Additional Government Pleader for the respondents-1 to 5. Since no order prejudicial to the interest of the 6th respondent is going to be passed, notice to 6th respondent is dispensed with.

2. By consent, the Writ Petition itself is taken up for final disposal.

3. The petitioner is said to have filed an appeal before the third respondent/Revenue Divisional Officer, Ramanathapuram, against the order of transfer of patta passed by the Tahsildar, Rameswaram Taluk, Ramanathapuram District. Since no order has been passed in the said appeal, he has made a representation before the third respondent on 25.11.2015. Even then, no order has been passed by the third respondent. Hence, he has filed this Writ Petition.

4. In the above circumstances, the third respondent is directed to consider the appeal if any filed by petitioner is pending before him and pass suitable orders on the same, on merits and in accordance with law, after giving notice to all the parties concerned. Such exercise shall be completed within a period of twelve weeks from the date of receipt of a copy of this order. With the above direction, this Writ Petition is disposed of. No Costs.
