For Respondent : Mr.R.M.ANBUNITHI, Additional Public Prosecutor PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.894 of 2022 on the file of the respondent Police.
ORDER : The Court made the following order :- The petitioner/Accused (Rank Not Known), apprehending arrest at the hands of the respondent police for the alleged offences punishable under Sections 294(b), 427 and 506(ii) of I.P.C, in Crime No.894 of 2022 on the file of the respondent police, seeks anticipatory bail.
2.When the matter was taken up for hearing on 04.08.2022, submission has been made by the learned counsel for the petitioner that in Crl.OP(MD)No.11760 of 2022, dated 21.07.2022, the co-accused were released on bail by directing to deposit a sum of Rs.3 lakhs to the credit of this Crime Number before the concerned Court and the matter was ordered to be listed today for producing the receipt of deposit for considering this petition.
3. As per the direction, a copy of the receipt of deposit before the concerned Court also produced before this Court. Since the order that has been passed by this Court, dated 21.07.2022, has been complied by depositing a sum of Rs.3 lakhs to the credit of this Crime Number.894 of 2022 before the concerned Court, this Court is inclined to grant anticipatory bail to the petitioner. https://www.mhc.tn.gov.in/judis 1/2

4. Accordingly, this Criminal Original Petition is allowed and petitioner is ordered to be released on bail in the event of arrest or on his appearance, before the learned Judicial Magistrate No.II, Trichy, on condition that the petitioner shall execute a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and the petitioner shall appear before the respondent police daily at 10.30 a.m. until further orders. The petitioner shall comply with the condition stipulated under Section 438 Cr.P.C. Scrupulously.
5.The petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail stands dismissed.
