PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the second respondent to grant group insurance amount payable to the petitioner in view of death of the petitioner's husband M.Ravichandran, S/o. Mayandi Thevar, while he was working under the fourth respondent, by considering petitioner's representation dated 06.03.2019, within the period as stipulated by this Court. O R D E R
The petitioner is the wife of one Ravichandran, who served as a Secretary in the fourth respondent Bank and died on 21.09.2018. During his service, he was enrolled in group insurance policy by the fourth respondent and the petitioner's name has been shown as nominee in the policy. As per the Scheme of the policy, the premium has to be regularly paid by the fourth respondent by deducting the same from the salary of her husband. After his demise, claiming the insurance amount of her deceased husband, the petitioner has made a request and has also filed this writ petition.

2.Today(18.12.2024), when this writ petition is taken up for hearing, the learned counsel appearing for the second respondent submits that the husband of this petitioner Ravichandran was placed under suspension. Pending an enquiry under Section 81 of the Tamil Nadu Co-operative Societies Act, the premium amount due to be paid for the group insurance scheme for the deceased Ravichandran was not deducted from his salary. According to the learned Counsel for the second respondent Society, the fourth respondent has not deducted the premium amount, since the petitioner's husband Ravichandran was placed under suspension at the relevant period and therefore, the request of this petitioner was rejected by a proceedings in Na.Ka.No. 1108/11-12/P2, dated 29.06.2019. However, the petitioner, without challenging the same, has filed this writ petition, seeking a Mandamus. A copy of the above proceedings is also placed before this Court. 3.In reply, the learned counsel for the petitioner claims that the above proceedings, dated 29.06.2019 was not served on her. 3/6
4.Considering the submission made by the learned counsel for the second respondent that the premium amount for the period, in which, the petitioner's husband was in suspension has not been deducted and remitted by the fourth respondent Bank to the second respondent and a proceedings has also been issued to that effect on 29.06.2019, this Court is not inclined to grant any mandamus as prayed for.
5.Accordingly, this writ petition is dismissed with a direction to the second respondent to furnish a copy of the proceedings to the petitioner and the petitioner is at liberty to challenge the proceedings, dated 29.06.2018 in the manner known to law.
