PRAYER: Criminal Original Petition is filed under Section 528 of BNSS Act, to call for the records relating to the order dated 07.05.2026 in Crl.M.P.No.1306 of 2026 in C.A.No.168 of 2026 on the file of the Vacation Sessions Judge, Virudhunagar District at Srivilliputhur, S.T.C.No.1517 of 2025 on the file of Judicial Magistrate, Fast Track Court, Srivilliputhur and set aside the same with respect to the portion of the order directing the petitioners to deposit a sum of Rs.6,60,000/- (10% of the compensation amount) before the trial Court within one month, and allow the Criminal Original Petition. ORDER

The present petition has been filed by the accused persons in S.T.C.No. 1517 of 2025, challenging the condition imposed in the order of suspension of sentence passed by the learned Vacation Sessions Judge, Virudhunagar District, in Crl.M.P.No.1306 of 2026 in C.A.No.168 of 2026.

2. According to the learned Counsel appearing for the petitioner, they find it difficult to deposit a sum of Rs.6,60,000/- and therefore, the amount fixed by the Court may be reduced and further time may be granted to the petitioner to deposit the same.

3. Considering the grievance expressed by the petitioner, the order impugned in the petition is hereby modified and the petitioner is directed to deposit a sum of Rs.3,50,000/- (Rupees Three Lakhs Fifty Thousand only) on or before 10.07.2026.
