This Criminal Miscellaneous Petition has been filed seeking extension of the time fixed by this Court for payment of costs to enable the recall of P.W.2 for cross-examination.

2. An order was passed by this Court on 29.10.2024 permitting the petitioner to recall P.W.2 for cross-examination on payment of Rs. 15,000/- to P.W.2 within one week from the date of receipt of a copy of the said order. The order dated 29.10.2024 was uploaded on the website on 24.12.2024, and the certified copy was despatched on 25.02.2025. However, the petitioner failed to pay the cost as directed by this Court. The present petition seeking extension of time to pay the cost has been filed only on 19.06.2025. Admittedly, Spl.C.C. No.33 of 2022 on the file of the Special Court for Exclusive Trial of Cases under the POCSO Act, Tirunelveli, is now posted for arguments.

3. In view of the above, this Court is not inclined to entertain this petition, as it has been filed only to delay the proceedings. Therefore, this Criminal Miscellaneous Petition is dismissed. 27.11.2025 JEN Index: Yes/ No Page No. 2 of 4
