ORDER

This petition is filed seeking a direction to the 2nd respondent to to expedite the investigation of FIR in Crime No.230 of 2020 pending on his file and to file a final report within a time frame that may be stipulated by this Court.

2.The petitioner is the defacto complainant in Crime No.230 of 2020, which was registered for the offences punishable under Sections 436 IPC. The learned counsel for the petitioner submitted that on the date of occurrence 24 soverigns of gold jewels, 3⁄4 kgs of silver articles and cash of Rs.50,000/- were stolen from the petitioner's house. Now the grievance of the petitioner is that even though after a lapse of one year, the respondent police has not taken any steps to recover the articles and arrest the accused. There is no progress in the investigation.

3.The learned Government Advocate (Crl.side) for the respondent would submit that so far 12 witnesses have been examined, but no clue is available with regard to the properties and hence, no arrest https://hcservices.ecourts.gov.in/hcservices/ 1/2

Crl.O.P.(MD) No.14064 of 2021 can be made till now and within 3 months, investigation will be completed and the final report will be filed before the concerned court.

4.Perusal of the CD file also shows that no recovery has been made so far. Therefore, recording the submission and accepting the request made by the learned Government Advocate (Crl.side), there shall be a direction to the 2nd respondent to complete the investigation and file final report within a period of 3 (three) months from the date of receipt of a copy of this order. After filing final report before the concerned court, compliance report must be submitted to the Registry.

5.This petition is allowed, accordingly.
