ORDER : This Court made the following order :- The petitioner / Accused, who was arrested and remanded to judicial custody on 13.05.2025 for the offences punishable under Sections 303(2) of BNS in Crime 1/3

No.572 of 2025 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that on 11.05.2025, the defacto-complainant went to Alagar Festival, at that time, by using the crowded situation, this petitioner stolen 15 sovereign of gold Thali chain of the defacto-complainant. Hence, the case.

3. The learned counsel for the petitioner would submit that the petitioner is an innocent person and she has not committed any offences as alleged by the prosecution. The petitioner is ready and willing to abide and conditions that may be imposed by this Court. He would further submit that the petitioner is in custody from 13.05.2025 nearly 43 days. Hence, he seeks bail.

The learned Government Advocate (Criminal Side) would submit that on 11.05.2025, this petitioner by using crowded situation in the Alagar Festival stolen 15 sovereigns of gold Thali chain from the defacto-complainant. A melted gold was recovered from the petitioner. This petitioner is having three previous cases, all are similar in nature. If, the petitioner released on bail, she involved in more criminal activities. Hence, he strongly objected to grant bail to the petitioner.

Taking into consideration of the facts and circumstances of the case and also taking note of the manner in which the offence committed, this petitioner is having three previous cases, all are similar in nature, and considering the gravity of offence, this Court is not inclined to grant bail to the petitioner. 2/3
