PRAYER:- Writ Petition, filed under Article 226 of the Constitution of India, praying this court to issue a WRIT OF CERTIORARIFIED MANDAMUS calling for the records pertaining to the impugned proceeding issued by the second Respondent in Na.Ka.No. 00398/2023/E1 dated 29.05.2026 and quash the same and consequently directing the Respondents 1 and 2 to permit the Petitioner is continued to work as Assistant Manager under the second Respondent Bank. In all the petitions:
For Petitioner : Mr.N.Satheesh Kumar For R1 : Mr.K.K.Udayakumar Government Counsel For R2 : Mr.D.Shanmugaraja Sethupathy For R3 : Mr.M.Ganesan COMMON ORDER These writ petitions have been filed seeking writ of certiorarified mandamus challenging the proceedings in Na.Ka.No.00398/2023/E1 dated 29.05.2026, whereby the petitioners were intimated about an order passed by the Co-ordinate Bench of this Court in WP (MD)No. 3958 of 2026 dated 27.02.2026.
2. A Coordinate Bench of this Court, by the said order dated 27.02.2026 having taken note of the contentions of the learned counsel for the petitioner therein that promotions have been effected contrary to 3/8
the law laid down by the Hon'ble Apex Court in the case of Bimlesh Tanwar vs. State of Haryana and others reported in (2003) 5 SCC 604, directed the respondent Bank therein to revise the promotions, in case, if the promotions were made contrary to the decision of the Hon'ble Apex Court.
3. Though the petitioners were made parties in the said writ petition, notice to the petitioners was dispensed with by this Court as no order was passed by this Court on merits and the matter was relegated to the respondents therein for consideration. Through the impugned proceedings, the petitioners were informed about the order passed by this Court. Hence, the petitioners cannot be said to be persons aggrieved by the impugned proceedings. If at all, the petitioners are aggrieved by the order dated 27.02.2026 passed by this Court, it is for them to take appropriate steps.
4.According to the learned counsel for the petitioners, the petitioners are not aggrieved by the said order nor aggrieved by the 4/8
revised seniority that was issued as early as on 23.10.2025, wherein the petitioners herein were arrayed as junior to the third respondent. However, the learned counsel for the petitioners contends that the petitioners were promoted as the Assistant Manager as early as in the year 2014 and have been continuing as such for the past twelve years and reversion at this stage would seriously prejudice the petitioners both monetarily and as well as socially. He further contends that there are number of vacancies available in the post of Assistant Manager and therefore, the respondents instead of reverting the petitioners to the lower category, they can as well consider the case of the petitioners for promotion to the post of Assistant Manager from a later date in terms of the revised seniority.
Hence, the petitioners seek a direction to the respondents to permit the petitioners to continue to work as the Assistant Manager duly altering the date of promotion of the petitioners. As the impugned proceeding is only a formal communication communicating the order passed by this Court, as observed above, this Court is not inclined to interfere with the impugned proceedings.
the subsequent vacancies. There appears to be some vacancies available in the post of the Assistant Manager as on 31.08.2021
5. In the light of the above, the petitioners are granted liberty to submit representations before the second respondent making such a claim for adjusting them against the vacancies available as on date instead of reverting them. In case, if the petitioners make any such representations, the same shall be considered and appropriate orders shall be passed thereon on merits.
6. Accordingly, the writ petitions are disposed of. No costs. Consequently, connected miscellaneous petitions are closed. 10.06.2026 NCC : Yes/No Index : Yes/No Internet : Yes/No CM 6/8
