O R D E R

This petition is filed seeking quashment of Crime No.50 of 2020 on the file of the first respondent.

2.It appears that the matter is repeatedly getting adjourned only on the ground that reschedule for repayment. 3.When the matter is taken up for hearing, the learned counsel for the petitioner would submit that because of loss in his hotel business, he is not in a position to repay the agreed amount. Out of Rs.80 lakhs, Rs.5 lakhs has already been paid and balance amount of Rs.75 lakhs (Rupees Seventy Five Lakhs Only) has to be paid. Crl.OP(MD)No.13959 of 2020 4.The learned counsel for the third respondent would submit that the petitioner shall pay the above said Rs.3 lakhs per month, which is to be started from 20.01.2022 and the amount must be paid on or before 20th day of every month till the agreed amount, is fully paid.

5.Considering the submission made by the learned counsel for the third respondent, the petitioner is directed to pay a sum of Rs.3 lakhs (Rupees Three Lakhs Only) per month, which shall start from 20.01.2022 onwards and the installment amount shall be paid on or before 20th day of every succeeding English Calender Month, till the settlement of agreed amount i.e., Rs.75,00,000/- (Rupees Seventy Five Lakhs Only).

6.With the above direction, this Criminal Original Petition is disposed of. Consequently, the connected miscellaneous petitions are closed.
