J U D G M E N T

[Judgment of the Court was made by S.VAIDYANATHAN, J.] This intra-court appeal is directed against the order dated 08.06.2023, passed in W.P.(MD) No.13160 of 2023, rejecting the request of the appellant to quash the order of transfer dated 08.05.2023, passed by the second respondent.

2. Admittedly, after issuance of the order of transfer, the appellant / writ petitioner has been relieved from service on 11.05.2023. The learned Single Judge gone through the materials available on record and came to the conclusion that there is no legal ground to interfere with the order of transfer. Merely because the appellant is a single mother and her child is having some medical issues, Courts cannot interfere with the order of transfer, on the ground of sympathy. It is for the authority concerned to consider the same. Hence, we find no ground to interfere with order passed by the learned Single Judge and the writ appeal is therefore liable to the dismissed.

3. Accordingly, this writ appeal fails and it is dismissed. No costs. Consequently, connected miscellaneous petition is closed. [S.V.N., J.] [D.B.C., J.] 06.07.2023 NCC :
