PRAYER : Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Certiorarified Mandamus, to call for the records in pertaining to the impugned refusal check slip of the 4th respondent in RFL/Viralimalai/55/2025, dated 12.05.2025, to quash the same as illegal, consequently, to to direct the 4th respondent to register the document presented by the petitioner in respect of survey number 395/2A2A2A for an extent of 0.16.25 hectors (40 cents) situated at Viralur Village, Viralimalai Taluk, Pudukkottai District.

ORDER

The present Writ Petition has been filed for the issuance of a Writ of Certiorarified Mandamus, to quash the impugned refusal check slip of the 4th respondent, dated 12.05.2025 and consequently, to direct the 4th respondent to register the document presented by the petitioner. 2.Through the impugned order, the official respondents have stated that already in Survey No. 395/2A2A2A, a document is registered under Document No.2941 of 2011. Again, the same property was registered in Document No.275 of 2025 and again the same property was registered in Document No.395 of 2025. Now, the present document is submitted again for registration in the petitioner's name.

3.The impugned order reflects that if the petitioner's document is registered, there will be double entry / multiple entries. Even if it is double entry / multiple entries, the official respondents ought to register with double entry / multiple entries. But the official respondents cannot refuse registration on the ground of double entry / multiple entries.

4.The said issue is already considered by a Learned Single Judge in the case of T.Sakthivel vs Sub Registrar in W.P.(MD)No.2214 of 2024 dated 17.10.2024. Further, another Learned Single Judge has also considered the same in W.P.No.16633 of 2025, vide order, dated 15-05-2025, wherein it is stated as under:

"5. The ground on which, the document has been refused to be registered is the fear of double entry in the records. The Hon'ble Mr.Justice Sathishkumar has held in T.Sakthivel /vs/ Sub Registrar in W.P.(MD)No. 2214 of 2024 dated 17.10.2024 that the Sub Registrar cannot refuse the registration of a document on the ground of double entry.

6. Respectfully applying the said judgment of the facts of the case, the impugned order is quashed. There shall be a mandamus as prayed for. The first respondent shall register the document within a period of two weeks from the date of uploading of the order on the website of this Court." 5.Therefore, following the same, the impugned order is quashed and the official respondents are directed to register the document presented by the petitioner indicating it as a double entry / multiple entries within a period of four 3/5

weeks from the date of receipt of a copy of this order. 6.With the above observations, this Writ Petition is allowed. There shall be no order as to costs.
