ORDER : The Court made the following order :- The petitioner/A1, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 342 and 302 of IPC in Crime No.334 of 2020 on the file of the respondent police, seeks anticipatory bail.
2. The case of the prosecution is that the 2nd accused is the wife of the deceased Karuppiah. The accused persons were allegedly in an illicit relationship with each other. When the deceased came to know about it, he, along with his mother, is said to have warned the 2nd accused. Thereafter, on 10.06.2020, in order to murder Karuppiah, the petitioner/1st accused is said to have bought liquor and made him drink it. Subsequently, at about 2.15 a.m., the petitioner, along with the 2nd accused, allegedly strangulated the deceased Karuppiah. Hence, the present case.
3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and has not committed any offence as alleged by the prosecution. He further submitted that the petitioner was admitted to Kala Hospital, Madurai, for kidney stone dialysis and, therefore, he could not appear before the trial Court. Despite informing his counsel, who was representing him before the trial Court, the said counsel failed to appear and file a petition under Section 317 of Cr.P.C. As a result, a Non-Bailable Warrant was issued against the petitioner on 11.06.2025. He also submitted that the petitioner is willing to abide by any conditions that may be 2/4
imposed by this Court. Hence, he seeks anticipatory bail for the petitioner.
4. The learned Government Advocate (Criminal Side) submitted that there are two accused persons in this case and the petitioner has been arrayed as A1. He further submitted that there are 67 previous cases registered against the petitioner. Hence, he strongly opposed to grant anticipatory bail to the petitioner.
5. Considering the facts and circumstances of the case, and considering the strong objection raised by the learned Government Advocate (Criminal Side), and also considering the gravity of the offence allegedly committed by the petitioner, and also taking note of the fact that there are 67 previous cases registered against the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner.
