Prayer: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the 1st respondent to dispose the petitioner's appeal dated 15.05.2026 within a time frame fixed by this Court.
ORDER
This Writ Petition has been filed seeking the issuance of a Writ of Mandamus directing the 1st Respondent to dispose of the petitioner's appeal dated 15.05.2026 within a time frame to be fixed by this Court.
2. The contention of the petitioner is that Respondents 4 and 5 have obtained a patta in respect of a property that, according to the petitioner, belongs to him. Aggrieved by the grant of such patta, the petitioner has preferred an appeal before the 1st Respondent, which is presently pending consideration.

The further contention of the petitioner is that Respondents 4 and 5 are putting up construction on the petitioner's house site without obtaining the requisite planning permission or building plan approval. In this regard, the petitioner has issued a legal notice dated 30.04.2026 to the Corporation. 2/6

In view of the above, the 3rd Respondent is directed to consider the petitioner's representation and verify whether Respondents 4 and 5 have obtained the necessary plan approval for the construction in question. In the event that no such approval has been obtained, the 3rd Respondent shall initiate appropriate action against Respondents 4 and 5 in accordance with law.
5. Further, if any construction is being carried out in violation of the sanctioned plan or without obtaining the requisite approval, the 3rd Respondent shall take appropriate action in accordance with law, including restraining further construction, if warranted. The aforesaid exercise shall be completed by the 3rd Respondent within a period of twelve (12) weeks from the date of receipt of a copy of this order.
6. As far as the appeal pending before the 1st respondent the same shall be considered after issuing notice to the petitioner and the respondents 4 & 5 and pass orders in accordance to law on merits within a period of four months from the date of receipt of a copy of the order.

7. With the above observations, this Writ Petition is disposed of. There shall be no order as to costs.
