Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus directing the first respondent to cause necessary entries in the revenue records inclusive of the ''computer generated patta'' in respect of the land assigned to us under the scheme of ''free house sites for the homeless poor of the Scheduled Caste Community'' in S.No.159, Kulathur Village and Taluk, Pudukkottai District on the basis of the individual orders of assignment of patta and in the light of the Petitioners representation, dated 3.5.2025 as expeditiously as possible within the time stipulated by this Court.

O R D E R

The Writ Petition is filed seeking a direction to the first respondent to mutate the revenue records in favour of the Petitioners in respect of the property assigned to them under the scheme of ''free house sites for the homeless poor of the 3/7

Scheduled Caste Community'' in S.No.159, Kulathur Village and Taluk, Pudukkottai District by considering the Petitioners representation, dated 3.5.2025.

2.Mrs.K.Malathi, learned Additional Government Pleader takes notice for the respondents 1 and 2 . By consent of both parties, the Writ Petition is taken up for final disposal at the admission stage itself.

3.According to the petitioners, land with an extent of 0.52.5 hectares in S.NO.159/2 in the above mentioned village was acquired by the Government for the purpose of providing free house site patta to the eligible poor people belonging to scheduled caste community. The Petitioners were issued with assignment orders in respect of the above mentioned land. Each of the Petitioners are assigned with 0.00.80 ares of land in the above mentioned acquired property. But in the revenue records, the names of the Petitioners/assignees have not been entered. Therefore the Petitioners have submitted a representation before the respondents on 21.4.2025 seeking issuance of revenue patta in the name of the Petitioners/assignees. The same has not been considered till date. Hence the Petitioners are before this court with the present Writ Petition for the relief stated supra. 4/7

4.Ms.K.Malathi, learned Additional Government Pleader who takes notice for the respondents 1 and 2 would submit that in view of the objection by the other villagers, request of the Petitioners have not been considered so far.

5.It is not in dispute that 0.00.80 ares of land in the above mentioned survey number has been assigned in favour of the Petitioners by the second respondent in his proceedings, dated 5.7.2024. In these circumstances, the request made by the Petitioners for mutation of revenue records shall be considered in accordance with law.

6.Therefore, the first respondent is directed to consider the representation of the Petitioner, dated 21.4.2025 and pass final orders on its own merits after affording opportunity to the Petitioners, objectors and other interested parties, if any, within a period of 12 weeks from the date of a copy of this order. 7.With the above direction, the Writ Petition stands disposed of. No costs.
